I think it does. Laws and decisions passed/made after previous supersede the old. Yeah, not sure how or when they're going to enforce, issue letters but looks like it's not going to be fun.

Well, don't go jumping the gun. Just wait to see how this shakes out, there is some much contradictory stuff here I think it's going to come down to a court case. So, once it goes to court we'll see how they address this since we're in NFA territory. Who knows, this maybe big win city.

True...I was even telling myself dont jump the gun, but did it anyway. We'll see how it pans out. If I get any hits at $1050 I'll just sell it and once the smoke clears I will build another pistol. Just sucks...I like that build.

From what I'm reading in both letters there's no legal issue with the Sig SB-15 brace on any pistol build (meaning it being physically present . . .still able to be bought and sold without a tax stamp), just the way you hold the weapon when firing it is the issue.
So there's never been any issue with the Sig Brace being physically present on a pistol build, there's just this contradictory 'Yes, it's legal to touch it to the shoulder as there's no illegal way to shoot a pistol' and a now few months later there's this 'No, it's not legal to hold the pistol in this way' song and dance.
With the AR pistol people have always used the buffer tube to touch against their cheek and shoulder to steady the whole contraption a little when firing since the beginning of AR pistols. Part of the design package. If they don't want anyone using the buffer tube period they shoulda just banned them from being on any non-NFA firearm to begin with.
That's fairly easy to enforce. Just like with non-registered sawed off shotguns or short barreled rifles some guy or gal gets pulled over going to and from the shooting range or private land that they shoot from or the police see it during some search of a house stemming from some other police contact, it seems short to them and they measure it and arrest the possessor...pretty straight forward. It's physically present on the gun or more importantly with the bobbed barrels *NOT* present on the gun.
With this situation though the Sig brace itself on an AR pistol is legal and the average Joe now has these two contradictory letters where one says that the action of touching it to the shoulder is legal and one where it states that it's illegal and the ATF is going to do what? Conduct surveillance on every gun range, on every deer lease and on every private piece of property in America to see if anyone touches this still legal brace up to their shoulder for even a second for the criminal prosecution supported by a fuzzy piece of a ruling that's already been given the green light once and where they've said that everyone is good to go and then ruled against and arbitrarily attached to an actual (possession of an SBR without a tax stamp) law? What about the shooter touching the bare buffer tube of an AR pistol to their shoulder? Does this mean that this action is illegal now as well?
I dunno, I don't see much of this happening. Pretty much the definition of unenforceable. If they had of just banned Sig braces or made them NFA items from the get-go that would have been one thing. Making the Sig Brace a taxable NFA item now is also an option.
Keeping one leg in and one leg out is what they're trying to do with this one though. Keeping the brace itself a regular accessory and instead defining the action of shouldering a gun the NFA item? That shit ain't going to work out, good luck with that.
I imagine this has occurred to the ATF as well. They've declared other items to be legally apart of the NFA after normal sales and then later compelled owners to register them. I wouldn't be surprised to see that happen with the Sig brace as well.

Well, sold my upper lol. $400 for the upper sans optic and WML. Decided to keep the pistol lower and convert it to a rifle. Ill keep the pistol tube with attached brace while I wait and see how this plays out, Ill be getting a 14.5 carbine gas to replace the shorty. Ive lost my attachment to guns...theyre all replaceable except heirlooms.

I don't know about the Sig brace ever being listed as a taxed NFA item, mostly because one of the purposes is to aid handicapped/disabled shooters (or so says Sig)...thus, making for a whole Americans with Disabilities Act nightmare if someone were take up that cause. It's all clownshoes...

I've been holding on to crap for way too long because of the whole "ermagash-neversellaweapon" mentality. Screw that. I'd rather have a set of guns that I'll actually USE rather than a couple safe queens that only get brought out for a giggle. I built my AR pistol a while ago due to the hunting regs in our state, and where I hunt. I either had the choice of a pistol, or a shotgun. Since I've built it, they've changed the zoning and repealed the shotgun/pistol zones, so now I can go back to using a rifle (like I did 20miles NORTH of where I am currently hunting!). Now the boat anchor sits - and it is a portly bitch. After using the AR to take a deer this last year, I don't mind the platform for hunting at all even though I got frowns from the 30-30 crew. I'm considering tearing the upper down, using it for a rifle length 300BLK and then selling off the barrel and converting the lower to a rifle. I shoot the rifle way more than the pistol anyway. All my pop's guns were taken before I even got a chance to see them by cousins - same thing happened with my grandfathers guns. No heirlooms in my collection just guns I've bought over the years, nothing to stop me from getting a decent gun to pass down to MY kids.

Well all i need is o order a barrel and hand guard to finish my AR pistol build. Done got the Sig brace and all. I may wait to see how this pans out before i order a barrel. Since it is not assembled yet i can just get a longer barrel for it. I got a complete BMC rifle build kit minus barrel i forgot i had.
I had an idea they may have been thinking about this type of thing with the pistol braces. I saw people put a folding AR pistol tube with Sig brace on a a Ruger Charge 22 pistol.Looked cool and all but things like that may have put it out there to much that the brace can be used as a stock. ATF got a letter asking about it to many times or something to alert them to the facts of how peopel are using braces.

When we initially mentioned it in 2012 it was quite the spectacle. Somewhere between then and now, the NSN and its maker Halix were cast upon the trash heap of bad ideas. Later, something much better came along. The SIG SAUER stabilizing Brace or SB15 was designed to allow the disabled to enjoy an AR Pistol and its associated recoil as much as any other Red Blooded American. I for one applaud SIG’s efforts on behalf of disabled gun owners. IMG_0678.JPG I only mentioned the NSN, the most unfortunate of inventions, because another trainwreck has transpired in the form of an ATF Firearms Technology Industry Services Branch (FTISB) issued determination letter from November on the popular SB-15 stabilizing brace from SIG SAUER. Despite the fact that earlier this year the ATF issued a determination letter that stated that misusing an SB15 fitted to an AR Pistol by shouldering it akin to a rifle did not make the rifle an SBR, plenty of people have been sending in letters of their own regarding their particular pistol builds. Now, how silly is that? As a kid, I learned that if mom gave you the answer you wanted, don’t go asking dad the same question. The question was asked again, for the umpteenth time. Of course, what do you think happened? This time, a determination letter came back that stated: “if this device, un-modified or modified; is assembled to a pistol and used as a shoulder stock, thus designing or redesigning or making or remaking of a weapon design to be fired from the shoulder; this assembly would constitute the making of a “rifle” as defined in 18 U.S.C. Section 921(a)(7).” Feel free to visit Prince Law for more info and a copy of the entire letter. Although it’s most disconcerting that the ATF can arbitrarily change its opinion, an AR Pistol fitted with an SB15 has been the only option for those who cannot own SBRs. Unfortunately, some folks ignore the “Yes” and keep asking until they get a “No.” Now, that option has become a bit more restrictive and disabled gun owners may lose their ability to enjoy AR pistols. Come on Sig, challenge this in court.

Pistol lower converted to rifle. I forgot how much I like having a stock, TBH. Anyone want my brace? Ill do like $60 shipped or maybe $70-$80 trade value. FYI getting a pistol tube with a shit ton of loctite on it off your lower SUCKS. Heat and liquid wrench didn't work..ended up using my castle nut wrench and forced it into the grooves in the RRA tube and was finally able to break it free. Lesson learned: use less loctite.
