Colleton deputies seize 48 pounds of pot in traffic stop

COLLETON COUNTY, SC (WCSC) -

Colleton County deputies arrested a 50-year-old man after they say found 48 pounds of marijuana in his vehicle during a traffic stop.

Ovidio Jesus Martinez is charged with trafficking marijuana, according to Colleton County Sheriff's Lt. Shane Roberts.

A deputy stopped a GMC Envoy on I-95 Tuesday at approximately 9:02 a.m. after seeing the vehicle change lanes without signaling, according to an incident report. Martinez told the deputy he was driving from North Carolina to Florida. The deputy reported seeing "several indicators of criminal activity," including a Red Bull Can, 5-hour Energy bottle, a coffee cup, a book bag in the rear seat and three new cardboard boxes in the rear cargo area, the report states.

A K-9 officer responded and alerted his handler during a free-air sniff that some type of drug activity was within the vehicle, the report states.

Deputies say they found 72 bags of a green leafy substance believed to be marijuana during a search of the vehicle.

Martinez was being held on a $10,000 bond, according to Colleton County court records.

Am I the only one that sees a problem with what the Deputy is describing as criminal activity???

They also look for things like a lot of fast food wrappers. Basically anything that indicates that the driver is trying to drive straight through from (let's say) Miami to NYC in one shot.   Drug couriers aren't fond of stopping at Motel 6, and their employers want the stuff moved NOW!!!!
Other factors they look at are age of the driver, vehicle type, is it a solo male driver or two guys, or a family?

I understand perceiving this stuff as clues, but in no way does any of it justify him being stopped.     None of it is illegal, thus there was no lawful grounds to stop him.
Now failure to use his turn signal, speeding, et al would open that door, but no further than any other traffic stop.

"improper lane change", "indicators of criminal activity", cop-speak for "I had a hunch, and had to come up with stupid but legally defensible reasons to detain the fool."

Meh. As much as I am against illegal / improper detaining of an individual during a traffic stop, the police have to be able to do their job. I've been pulled over, go bag in the backseat, monster cans stacked up like cordwood, and a large Dunkin' Donuts coffee cup balanced precariously in my lap. The officer let me know I had a taillight out and said "have a nice day".

They have to put something in the little box on the form besides "He looked suspicious". The PC lawyers would be all over that.
